Contratto di Licenza d'Uso delle Applicazioni AGAP
Versione 1.0 – in vigore dal 4 ottobre 2026
Il presente Contratto di Licenza d'Uso ("Licenza") disciplina l'utilizzo delle applicazioni, utility, droplet, web app, dei relativi aggiornamenti e della documentazione (singolarmente o collettivamente, il "Software") sviluppati e distribuiti da AGAP – Mauro Barresi ("Licenziante") tramite il sito apps.agap.it, Microsoft Store o altri canali ufficiali.
L'installazione, l'avvio o l'utilizzo del Software comportano l'accettazione della presente Licenza. Chi non intende accettarla non è autorizzato a installare né a utilizzare il Software.

1. Ambito di applicazione
1.1 Software interessato
La presente Licenza si applica a tutto il Software pubblicato dal Licenziante per il quale non sia previsto un contratto di licenza specifico.
1.2 Prevalenza delle condizioni specifiche
Se un Software è accompagnato da un proprio contratto di licenza (pubblicato nella relativa pagina, mostrato durante l'installazione o contenuto nella documentazione commerciale), tale contratto prevale sulla presente Licenza, che continua ad applicarsi per quanto non diversamente disciplinato.
1.3 Piattaforme di distribuzione
Per il Software ottenuto tramite piattaforme di terzi (ad esempio Microsoft Store), le condizioni della piattaforma relative a download, acquisto, pagamento, rimborsi e aggiornamenti si applicano in aggiunta alla presente Licenza, in quanto compatibili.
2. Uso personale e uso professionale
2.1 Uso personale gratuito
Salvo diversa indicazione nella pagina del singolo Software, l'utilizzo per finalità personali, domestiche, di studio o comunque estranee all'attività imprenditoriale, commerciale, artigianale o professionale eventualmente svolta dall'utente è gratuito.
2.2 Uso professionale o aziendale
L'utilizzo del Software nell'esercizio di un'attività imprenditoriale, commerciale, artigianale o professionale, ovvero all'interno di studi professionali, uffici, aziende, enti pubblici o privati e altre organizzazioni, è subordinato al rilascio di una licenza professionale da parte del Licenziante, alle condizioni – anche economiche – comunicate su richiesta tramite la pagina contatti.
2.3 Licenze a pagamento
Qualora un Software sia acquistato a titolo oneroso tramite un canale ufficiale, l'acquisto attribuisce il diritto d'uso nei limiti (numero di utenti, dispositivi, durata, finalità) indicati nelle relative condizioni commerciali o nella pagina del Software.
3. Concessione della licenza
Fatto salvo il rispetto della presente Licenza, il Licenziante concede all'utente ("Licenziatario") un diritto di utilizzo del Software:
- personale e non esclusivo;
- non trasferibile e non sublicenziabile, salvo quanto inderogabilmente previsto dalla legge;
- revocabile in caso di violazione della presente Licenza;
- limitato all'installazione e all'uso sui dispositivi di cui il Licenziatario ha la legittima disponibilità, in conformità alla documentazione del Software.
La presente Licenza non comporta alcuna vendita, cessione o trasferimento della proprietà del Software o dei relativi diritti di proprietà intellettuale.
4. Proprietà intellettuale
Il Software, il codice sorgente e il codice oggetto, l'architettura, le interfacce, la documentazione, i nomi, i loghi, gli elementi grafici e ogni altro elemento tutelato restano di esclusiva titolarità del Licenziante o dei rispettivi aventi diritto.
La Licenza attribuisce esclusivamente i diritti d'uso espressamente previsti. Ogni diritto non espressamente concesso è riservato al Licenziante.
5. Limitazioni d'uso
Salvo quanto inderogabilmente consentito dalla legge (in particolare dagli artt. 64-bis, 64-ter e 64-quater della Legge 22 aprile 1941, n. 633), il Licenziatario non può:
- a) vendere, noleggiare, concedere in leasing, sublicenziare o comunque mettere a disposizione di terzi il Software, anche a titolo gratuito;
- b) ripubblicare o redistribuire i file di installazione (ad esempio pacchetti ZIP, EXE o APK) su siti, store, repository o altri canali diversi da quelli ufficiali, senza il preventivo consenso scritto del Licenziante;
- c) modificare, adattare, tradurre, decompilare o disassemblare il Software, o crearne opere derivate;
- d) eludere, disattivare o alterare eventuali meccanismi di licenza, attivazione o protezione;
- e) rimuovere o alterare indicazioni relative a copyright, marchi o titolarità del Software;
- f) utilizzare il Software in violazione di legge o di diritti di terzi.
6. Canali di distribuzione e integrità del Software
Il Software deve essere ottenuto esclusivamente dal sito apps.agap.it o dalle piattaforme ufficiali indicate nelle relative pagine. Il Licenziante non risponde di copie del Software ottenute da fonti diverse, che potrebbero essere state alterate.
L'installazione di pacchetti scaricati direttamente dal sito (ad esempio APK per Android o archivi per Windows) può richiedere la modifica di impostazioni di sicurezza del dispositivo, che resta a cura e responsabilità del Licenziatario.
7. Natura del Software ed esclusione di garanzia
Il Software è costituito da utility sviluppate e mantenute da un singolo sviluppatore e può essere distribuito anche in versione beta o sperimentale. Può pertanto presentare errori, malfunzionamenti, incompatibilità o funzioni incomplete.
Nei limiti massimi consentiti dalla legge applicabile, il Software è fornito "così com'è" ("AS IS") e "come disponibile" ("AS AVAILABLE"), senza garanzie di alcun tipo, espresse o implicite, comprese quelle di idoneità a uno scopo particolare, di assenza di errori o di funzionamento ininterrotto.
Restano in ogni caso salvi i diritti che la legge riconosce in modo inderogabile ai consumatori, inclusi quelli previsti dal D.Lgs. 6 settembre 2005, n. 206 (Codice del Consumo).
8. Verifica dei risultati e backup
Il Software elabora file e dati dell'utente (ad esempio documenti, messaggi di posta, firme digitali, file XML o calcoli). Prima di utilizzarlo su dati rilevanti, il Licenziatario è tenuto a conservare copie di sicurezza adeguate e indipendenti e a verificare i risultati prima di farvi affidamento.
Il Software ha finalità di supporto e non sostituisce le verifiche, le certificazioni, gli strumenti ufficiali o i servizi qualificati eventualmente richiesti dalla legge, ad esempio in materia di firme elettroniche, posta elettronica certificata, fatturazione elettronica, calcolo di compensi o adempimenti telematici.
9. Limitazione di responsabilità
Nei limiti massimi consentiti dalla legge, il Licenziante non risponde di danni indiretti o consequenziali, quali perdita o alterazione di dati, mancato guadagno, interruzione dell'attività, decadenze o mancato rispetto di termini, derivanti dall'uso o dall'impossibilità di usare il Software.
Per le licenze a pagamento, l'eventuale responsabilità complessiva del Licenziante è limitata all'importo effettivamente corrisposto dal Licenziatario per la licenza nei dodici mesi precedenti l'evento.
Le limitazioni del presente articolo non si applicano nei casi di dolo o colpa grave del Licenziante (art. 1229 c.c.), di danni alla persona e negli altri casi in cui la responsabilità non possa essere limitata per legge.
10. Aggiornamenti, assistenza e disponibilità
Salvo diverso accordo scritto, il Licenziante non è tenuto a fornire assistenza, manutenzione, correzioni o aggiornamenti. Eventuali aggiornamenti possono modificare, aggiungere o rimuovere funzioni; il Licenziante può interrompere la distribuzione di un Software in qualsiasi momento.
Alcune applicazioni possono verificare la disponibilità di nuove versioni interrogando il sito del Licenziante. Le richieste di supporto possono essere inviate tramite la pagina contatti e sono gestite su base volontaria, salvo accordi specifici.
11. Dati personali
Il trattamento di eventuali dati personali è descritto nella Privacy Policy delle applicazioni AGAP e, ove presente, nell'informativa specifica del singolo Software. Salvo diversa indicazione, i file dell'utente sono elaborati localmente sul dispositivo.
12. Componenti di terzi
Il Software può includere librerie, font o altri componenti di terzi, anche open source, che restano disciplinati dalle rispettive licenze. Nessuna disposizione della presente Licenza limita i diritti riconosciuti da tali licenze.
13. Durata e cessazione
La Licenza per uso personale ha durata indeterminata; le licenze professionali o a pagamento hanno la durata indicata nelle relative condizioni.
La Licenza cessa automaticamente in caso di violazione delle sue condizioni. Alla cessazione il Licenziatario deve interrompere l'uso del Software e disinstallarlo. Gli articoli 4, 5, 7, 8, 9 e 15 restano efficaci anche dopo la cessazione.
14. Modifiche alla Licenza
Il Licenziante può aggiornare la presente Licenza; la versione in vigore è sempre pubblicata in questa pagina con indicazione della data. Per le licenze a pagamento già rilasciate, le modifiche sostanziali sfavorevoli al Licenziatario si applicano solo dal successivo rinnovo.
15. Legge applicabile e foro competente
La presente Licenza è regolata dalla legge italiana.
Se il Licenziatario è un consumatore, per le controversie è competente il giudice del luogo di residenza o domicilio del consumatore, ai sensi dell'art. 66-bis del Codice del Consumo. In tutti gli altri casi è competente in via esclusiva l'autorità giudiziaria italiana.

Per richieste di licenza professionale, segnalazioni o domande sulla presente Licenza è possibile scrivere al Licenziante tramite la pagina dedicata.
Approvazione specifica delle clausole (artt. 1341 e 1342 c.c.)
Il Licenziatario che agisce per finalità imprenditoriali o professionali dichiara di avere letto e di approvare specificamente le seguenti clausole:
art. 2.2 – Subordinazione dell'uso professionale al rilascio di licenza;
art. 3 – Natura non esclusiva, non trasferibile e revocabile della Licenza;
art. 5 – Limitazioni d'uso;
art. 7 – Fornitura "AS IS" ed esclusione di garanzia;
art. 8 – Obblighi di verifica e backup;
art. 9 – Limitazioni ed esclusioni di responsabilità;
art. 10 – Assenza di obblighi di assistenza e aggiornamento;
art. 13 – Cessazione della Licenza;
art. 15 – Foro competente.
AGAP Applications License Agreement
Version 1.0 – effective from 4 October 2026
This License Agreement ("License") governs the use of the applications, utilities, droplets, web apps, related updates and documentation (individually or collectively, the "Software") developed and distributed by AGAP – Mauro Barresi ("Licensor") through the apps.agap.it website, Microsoft Store or other official channels.
Installing, launching or using the Software constitutes acceptance of this License. If you do not accept it, you are not authorized to install or use the Software.
This English text is provided for convenience. In case of discrepancy, the Italian version prevails.

1. Scope
1.1 Covered Software
This License applies to all Software published by the Licensor for which no specific license agreement is provided.
1.2 Precedence of specific terms
If a Software product comes with its own license agreement (published on its page, displayed during installation or included in commercial documentation), that agreement prevails over this License, which continues to apply to anything not otherwise regulated.
1.3 Distribution platforms
For Software obtained through third-party platforms (for example Microsoft Store), the platform's terms regarding download, purchase, payment, refunds and updates apply in addition to this License, to the extent compatible.
2. Personal and professional use
2.1 Free personal use
Unless otherwise stated on the page of a specific Software product, use for personal, household or study purposes, or otherwise unrelated to any business, commercial, craft or professional activity of the user, is free of charge.
2.2 Professional or business use
Use of the Software in the course of a business, commercial, craft or professional activity, or within professional firms, offices, companies, public or private bodies and other organizations, is subject to a professional license issued by the Licensor, on terms – including financial terms – provided upon request through the contact page.
2.3 Paid licenses
Where Software is purchased for a fee through an official channel, the purchase grants the right of use within the limits (number of users, devices, term, purpose) stated in the related commercial terms or on the Software page.
3. License grant
Subject to compliance with this License, the Licensor grants the user ("Licensee") a right to use the Software that is:
- personal and non-exclusive;
- non-transferable and non-sublicensable, except as mandatorily provided by law;
- revocable in the event of a breach of this License;
- limited to installation and use on devices lawfully available to the Licensee, in accordance with the Software documentation.
This License does not constitute any sale, assignment or transfer of ownership of the Software or of the related intellectual property rights.
4. Intellectual property
The Software, its source and object code, architecture, interfaces, documentation, names, logos, graphic elements and any other protected element remain the exclusive property of the Licensor or the respective right holders.
This License grants only the rights of use expressly set out herein. All rights not expressly granted are reserved by the Licensor.
5. Restrictions
Except as mandatorily permitted by law (in particular Articles 64-bis, 64-ter and 64-quater of Italian Law no. 633 of 22 April 1941), the Licensee may not:
- a) sell, rent, lease, sublicense or otherwise make the Software available to third parties, even free of charge;
- b) republish or redistribute installation files (for example ZIP, EXE or APK packages) on websites, stores, repositories or channels other than the official ones, without the Licensor's prior written consent;
- c) modify, adapt, translate, decompile or disassemble the Software, or create derivative works;
- d) circumvent, disable or alter any licensing, activation or protection mechanism;
- e) remove or alter copyright, trademark or ownership notices;
- f) use the Software in breach of the law or of third-party rights.
6. Distribution channels and Software integrity
The Software must be obtained only from the apps.agap.it website or from the official platforms indicated on the related pages. The Licensor is not responsible for copies of the Software obtained from other sources, which may have been altered.
Installing packages downloaded directly from the website (for example Android APKs or Windows archives) may require changing device security settings, which remains the Licensee's responsibility.
7. Nature of the Software and disclaimer of warranty
The Software consists of utilities developed and maintained by a single developer and may also be distributed as a beta or experimental version. It may therefore contain errors, malfunctions, incompatibilities or incomplete features.
To the fullest extent permitted by applicable law, the Software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including fitness for a particular purpose, absence of errors or uninterrupted operation.
Any rights mandatorily granted to consumers by law, including those under Italian Legislative Decree no. 206 of 6 September 2005 (Consumer Code), remain unaffected.
8. Verification of results and backups
The Software processes user files and data (for example documents, email messages, digital signatures, XML files or calculations). Before using it on relevant data, the Licensee must keep adequate and independent backup copies and verify the results before relying on them.
The Software is a support tool and does not replace checks, certifications, official tools or qualified services that may be required by law, for example regarding electronic signatures, certified email (PEC), electronic invoicing, fee calculations or electronic filings.
9. Limitation of liability
To the fullest extent permitted by law, the Licensor is not liable for indirect or consequential damages, such as loss or corruption of data, loss of profits, business interruption, forfeitures or missed deadlines, arising from the use of or inability to use the Software.
For paid licenses, the Licensor's total liability, if any, is limited to the amount actually paid by the Licensee for the license in the twelve months preceding the event.
The limitations in this article do not apply in cases of wilful misconduct or gross negligence of the Licensor (Article 1229 of the Italian Civil Code), personal injury, or other cases where liability cannot be limited by law.
10. Updates, support and availability
Unless otherwise agreed in writing, the Licensor is under no obligation to provide support, maintenance, fixes or updates. Updates may modify, add or remove features; the Licensor may discontinue distribution of any Software at any time.
Some applications may check for new versions by contacting the Licensor's website. Support requests can be sent through the contact page and are handled on a voluntary basis, unless specifically agreed.
11. Personal data
The processing of any personal data is described in the AGAP Apps Privacy Policy and, where available, in the specific notice of each Software product. Unless otherwise stated, user files are processed locally on the device.
12. Third-party components
The Software may include libraries, fonts or other third-party components, including open-source ones, which remain governed by their respective licenses. Nothing in this License limits the rights granted by those licenses.
13. Term and termination
The personal-use License has an indefinite term; professional or paid licenses have the term stated in the related conditions.
The License terminates automatically if its terms are breached. Upon termination, the Licensee must stop using the Software and uninstall it. Articles 4, 5, 7, 8, 9 and 15 survive termination.
14. Changes to this License
The Licensor may update this License; the version in force is always published on this page with its effective date. For paid licenses already issued, material changes unfavorable to the Licensee apply only from the next renewal.
15. Governing law and jurisdiction
This License is governed by Italian law.
If the Licensee is a consumer, disputes fall within the jurisdiction of the court of the consumer's place of residence or domicile, pursuant to Article 66-bis of the Italian Consumer Code. In all other cases, the Italian courts have exclusive jurisdiction.

Specific approval of clauses (Italian Civil Code Arts. 1341 and 1342)
A Licensee acting for business or professional purposes declares to have read and specifically approves the following clauses:
